Resolution details

RESOLVED UNANIMOUSLY that:

a. The application for subdivision of Portion 18 of the Paarl Farm No 732 into two portions (Portion one and the Remainder) as per Annexure C1 in terms of Section 42 (d) of the Municipal Planning By-Law, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.

b. The application for subdivision of unregistered erf 37260 into three portions (Portions 1 & 2 and the Remainder) as per Annexure C1 in terms of Section 42 (d) of the Municipal Planning By-Law, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.

c. The application for the consolidation of portion 1 of unregistered erf 37260 with the Remainder of Portion 18 of the Paarl Farm No 732 as per Annexure C1 in terms of Section 42 (f) of the Municipal Planning By-Law, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.

d. The application for the consolidation portion 2 of unregistered erf 37260 with newly approved consolidated erf 39007 as per Annexure C1 in terms of Section 42 (f) of the Municipal Planning By-Law, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.

e. The application for subdivision of the consolidated portion/s into 10 phases (Phases 1-10) and further subdivision of phase 9 into a further 4 sub-phases (Phases 9A-9D) as per Annexure C2 in terms of Section 42 (d) of the Municipal Planning By-Law, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.

f. The application for rezoning of consolidated portion from Agricultural and Open Space to Subdivisional Area Overlay to allow for Residential (SR1 & SR2), Community Zone 1: Local (CO1), Open Space 2 (OS2), Subdivisional Area Overlay (SAO), Mixed Use 1 (MU1), Utility Zone (UT) and Transport Zoning 2: Public Road & Public Parking (TR2) as per Annexure C3 in terms of Section 42 (a) of the Municipal Planning By-Law, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.

g. The application for subdivision of the phases and sub-phases into further 409 SR1 portions (±4.05ha), 1278 SR2 portions (±11.23ha), 4 CO1 portions (±0.34ha), 7 OS2 portions (±0.93ha), 1 SAO portion (±7.92ha), 3 MU1 portions (±2.47ha), 2 UT portions (Elec. Sub-station & pump station)(±0.07ha), 1 UT (Stormwater management facility)(±3.69ha) and 12 TR2 portions (±13.60ha) as per Annexure C3 in terms of Section 42 (d) of the Municipal Planning By-Law, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.

Condition 2.5 is deleted.

That the Numbering sequence in Annexure A be corrected after condition 2.6
That the spelling of the word “formulised” be replaced with “formalised” in condition 6.1

Condition 6.9 is amended as follows:

6.9 That a Master Landscaping Plan gives consideration to the incorporation of a recreational component that relate to SWMP, DPSP & SDPSP.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons as set out in Planner’s report and added two additional reasons that read as follows:

7.1. 12 That careful attention has been given to integration with the surrounding residential areas.
7.1.13 the attempt to unlock economic opportunity is commendable
