UNANIMOUSLY RESOLVED that:
a. The application for consolidation, as set out in Annexure A, on Remainder Erf 2241 and Erf 3549 Pinelands, BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure C.
b. The application for departures from conditions in Item 19 of the Development Management Scheme, as set out in Annexure A, on Remainder Erf 2241 and Erf 3549 Pinelands, BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law 2015, in accordance with the plan indicated in Annexure D.
REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and agreed to amend the following:
7.1.5 The proposal has not been sufficiently motivated with regard to key aspects of the application eg departures, coverage, increase in floor factor, traffic impact
7.1.6 The proposal and its 246 parking bays will negatively impact on the surrounding strained road network as well as access into and out of the centre and its parking facilities
