UNANIMOUSLY RESOLVED that:
a. The application for a deletion of restrictive title deed conditions, as set out in Annexure A, for Erven 10, 11 and 12 Edward Township, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The application for a deletion of a condition of an existing approval, as set out in Annexure A, for Erven 10, 11 and 12 Edward Township BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for the consolidation of Erven 10, 11 and 12 Edward Township BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
d. The application for rezoning of the consolidated property comprising Erven 10, 11 and 12 Edward Township from Single Residential 1 (SR1) to General Residential 2 (GR2) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
e. The application for a permanent departure, as set out in Annexure A, for the consolidated property comprising Erven 10, 11 and 12 Edward Township BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Correct paragraph 7.1.9 in the planner’s report as follows:
The proposal has been evaluated in terms of Section 39(5) of the Land Use Planning Act 2014 and Section 47 of the Spatial Planning and Land Use Management Act, 2013 and it is considered that the social benefit / public interest to the broader community outweigh any benefits to the immediate property owners and those who are the beneficiaries of the restrictions.
Amend Annexure A
Amend paragraph 2.1.1 as follows:
A site development plan, generally in accordance with the concept site development plans attached hereto as Annexure C be submitted for approval by the Dir: DM prior to building plan submission…
