RESOLVED UNANIMOUSLY:
That the application for a temporary departure to permit the use of unregistered Erf 2596 (portion of Remainder Erf 1459) Hout Bay for shelters and ancillary purposes for a period of 5 years, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A.
ADDITIONAL CONDITION
After 5 years, or if the site is decommissioned before such time, the applicant must remove all site infrastructure, shelters and building materials and the site must be rehabilitated, within one month, to its former state or to a condition that is in line with the land use and character of the area at the time, as required by the Director: Development Management.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the planner’s report except reason 7.1.8 and 7.1.10 which are amended as follows:
7.1.8 The proposal will not have a significant adverse impact on traffic.
7.1.10 The proposal will contribute to the spatial development principles in terms of Section 7 of SPLUMA including spatial justice, spatial sustainability, efficiency and spatial resilience, by facilitating an essential upgrade of a relatively well located informal settlement, that has been negatively affected over many years by a poor urban environment and poor infrastructure.
