RESOLVED UNANIMOUSLY

a. That the application for the rezoning of Erf 46115 Cape Town at Rondebosch, from Single Residential Zone 1 to Subdivisional Area to permit the subdivision of the property into 3 portions, with Portion 1 being zoned General Residential Subzone GR2, Portion 2 being zoned Transport Zone 2 and the Remainder being zoned Single Residential Zone 1 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. That the application for the subdivision of Erf 46115 Cape Town at Rondebosch, as per plan of subdivision LUM/00/46115, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, subject to the conditions contained in Annexure A.

c. That the application for Council’s approval in terms of Item 162(1) of the Development Management Scheme, to permit building work and subdivision within a heritage prtection overlay zone, for Erf 46115 Cape Town at Rondebosch, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, subject to the conditions contained in Annexure A.

d. That the application for departures, as set out in Annexure A, Erf 46115 Cape Town at Rondebosch, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.


ANNEXURE A

APPLICATIONS GRANTED 1.4.3, 1.4.4, 1.4.5, 1.4.6 and 1.4.7 ARE AMENDED AS FOLLOWS:

1.4.3. Item 41(e): To permit the flat complex No 6 to be setback 2.46m in lieu of 5.21m from the western common boundary.
1.4.4. Item 41(e): To permit the block No 5 to be setback 3.5m in lieu of 8.24m from the western common boundary.
1.4.5. Item 41(e): To permit the blocks No 1 and 3 to be setback 3.5m in lieu of 7.48m and 8.24m respectively from the southern common boundary.
1.4.6. Item 41(e): To permit the block No 1 to be setback 3.6m in lieu of 4.5m from Lovers Walk.
1.4.7. Item 41(e): To permit the flat complex No 2 to be setback 4.15m in lieu of 4.5m from Lovers Walk.

CONDITION

That the word “SPACE” be replaced with “SPACES” in Condition 2.2.2

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 7.1.9 which is amended as follows:

7.1.9 There will not be a significant negative impact on heritage and the application is supported by Heritage Western Cape and Council’s Heritage Department.
