Resolution details

RESOLVED that:
a. The amendment of conditions 2.1 and 2.2 of the consent use approval granted 13 September 2017 on erf 10927, Milnerton, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

b. The amendment of condition 2.2 of the consent use approval dated 13 September 2017 to change the operating times from 10:00 – 17:00 to 09:30 – 19:00 on erf 10927, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report.

Reason 7.1.2: Amend to read:
The motivation is lacking in proving how a change in scale of operations will not impact negatively on the surrounding community.

A further reason in support of the change in operating times is as follows; being 7.1.4:
Most parents work and extending the operating hours will not undermine the integrity of adjoining properties or materially impact negatively on such properties.
