UNANIMOUSLY RESOLVED that:
a. The application for the regulation departure to permit the encroachment of the 3m common boundary building line to 0m to accommodate a new bathroom on erf 19616, Milnerton BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015 in accordance with plan no 17116 Sheet 1 of 3 dated the 13-04-18 drawn by: Level 7 Architecture Studio, subject to the conditions contained in Annexure A.
b. The application for the regulation departure from the 5m street boundary building line to 4.5m to permit a portion of the new garage on erf 19616, Milnerton BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015 in accordance with plan no 17116 Sheet 1 of 3 dated the 13-04-18 drawn by: Level 7 Architecture Studio, subject to the conditions contained in Annexure A.
c. The application for the common boundary building line departure from 3m to 1.5m to permit a first floor balcony 2015 as shown on plan no 17116 Sheet 2 of 3 dated the 13-04-18 drawn by: Level 7 Architecture Studio, on erf 19616, Milnerton BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report.
