UNANIMOUSLY RESOLVED that:
a. The application in terms of Section 42(b) for the relaxation of the 3m common building line to 0m to permit the proposed timber deck with pergola on the south-western common boundary, on Remainder Erf 2502, Somerset West, be considered in an amended form and that a setback of 2m BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The application in terms of Section 42(b) for the relaxation of the 3m common building line to permit the proposed second dwelling and external staircase to be setback 1.8m & 0.90m in lieu of 3m from the southern common boundary, on Remainder Erf 2502, Somerset West, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. The application in terms of Section 42(b) for the relaxation of Item 22(e)(i) to permit an external door be setback 0.9m in lieu of 1.5m from the southern common boundary, on Remainder Erf 2502, Somerset West, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.

That the southern boundary of the stair and deck be adequately screened to provide privacy to the property south of the development (erf 9241), to the satisfaction of the authorized official
