RESOLVED UNANIMOUSLY
a. That the application for the Removal of Restrictive Title Conditions C iii(b), (c) and (d) from title deed T46125/2017, which is incorrectly transcribed as Condition Cii, relating to Erf 1745 Bellville, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.
b. That the application for the Removal of Restrictive Title Conditions C3(b), (c) and (d) of title deed T46124/2017 relating to Erf 1746, Bellville, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.

Application 1.1 is amended as follows:
1.1 The application for the removal of Restrictive Title Conditions C iii (b), (c) and (d) from title deed T46125/2017, which is incorrectly transcribed as Condition C ii, relating to Erf 1745 Bellville, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons in the Planner’s report except reason 7.1.1 as amended below:
Reasons for the recommended decision for approval relating to the application for Removal of Restrictive conditions C iii(b), (c) and (d) from title deed T46125/2017, which is incorrectly transcribed as Condition C ii, relating to Erf 1745 and conditions C3(b), (c) and (d) of title deed T46124/2017 relating to Erf 1746, Bellville, respectively may be summarised as follows:
7.1.1 The proposal has been considered in terms of Section 39(5) of LUPA and Section 47 of SPLUMA. As discussed in paragraph 6.3 of the departmental report, it is considered that there will not be deprivation of rights or benefits to the parties involved.
