Resolution details

RESOLVED that:
a. The application for the rezoning of Erf 4252, 29 Rhus Street, Gordon’s Bay, from Single Residential Zone 1 to General Residential Zone 4, to allow for the establishment of 7 apartment units, ranging between 50m2 and 264m2 in extent, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto;

b. The application for the relaxation of restrictive conditions, as contained in Clause C(iii)(b)(c) and (d) of title deed No.T18322/1968 and referenced in Clause 2.A & B. of title deed No. T000045796/2017, so as BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto.

c. The application for permanent departures on Erf 4252, 29 Rhus Street, Gordon’s Bay listed in Annexure A of the report BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT APPROVED the application for the following reasons:

1. The background of previous planning approvals and legally compliant development on the property justifies specific circumstances for approval on this site
2. The appearance of the future urban and architectural form will not be materially different from the existing form
3. Conditions limiting the scale and form of the building mitigate the impact
4. This is a pragmatic and acceptable solution to regularize the existing building

Amend Annexure A:
Delete 2.3
