RESOLVED UNANIMOUSLY

That an administrative penalty in the amount of R3 000,00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 3557 Simon’s Town, with regard to the unauthorised building work as per the plan drawn by the Drawing Office Academy, with drawing number ADE-05-15-REV2, Revision 2, dated May 2015.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 6.5 which is amended as follows:

6.5 The conduct of the owner cannot be condoned and the explanation provided by the applicant for the unauthorized building work is factually incorrect.
