UNANIMOUSLY RESOLVED that:
a. The application for rezoning of a portion of Rem Erf 1603, Bakkershoogte, from Single Residential Zone I to Utility Zone to regularise the existing freestanding cellular base station and mast BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015
b. The application for regulation departure from the DMS to regularise a freestanding lattice mast of 35m in height in lieu of the specified maximum height of 25m on Rem Erf 1603, Bakkershoogte, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015
REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and agreed to amend reason 6.1.3 as follows:
The proposed mitigation measures will be futile in addressing the scale and resultant negative visual impact of the mast.
Add new 6.1.6:
Planning permission that was previously granted, was of a temporary nature
