RESOLVED UNANIMOUSLY

a. That the application for the rezoning of Erf 13839 Constantia, from Single Residential Zone 1 to General Residential Subzone GR2, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. That the application for consent in terms of Item 40(b) of the Development Management Scheme to permit a hotel on Erf 13839 Constantia, BE APPROVED in terms of section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

c. That the application for departures, as set out in Annexure A, for Erf 13839 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.


ANNEXURE A

Number 2 under Annexure A is changed to read: Conditions imposed in terms of Section 98(b) of the Municipal Planning By-law, 2015, imposed as part of the rezoning

Condition 3.1.6 is amended as follows:

3.1.6 No disturbance from loud music or other sources after 23h00 will be permitted and that the applicant submits a noise management plan for approval by the authorized official.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
