UNANIMOUSLY RESOLVED that:
a. The application for the rezoning of Portions of Erf 1955, Remainder Erf 2190 (Portion of Erf 1056), Erf 2191(Portion of Erf 1056), Remainder Erf 2166, Remainder 1559 and portions of Erf 1560, Granger Bay from Community Zone (CO2), Open Space Zone (OS2), and Transport Zone (TR2) to General Business (GB6) in terms of Section 42(a), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions attached as Annexure A.

b. The application for subdivision of Erven 2190, 1955, and 1560, Granger Bay in terms of Section 42 (d) of the Municipal Planning By-Law, 2015, as set out in Annexure A, and as shown on the subdivision and consolidation plan attached as Annexure B2, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. The application for consolidation of various portions and erven in Granger Bay, as set out in Annexure A, and as shown on the subdivision and consolidation plan attached as Annexure B2, in terms of Section 42(f) of the Municipal Planning By-Law, 2015, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.

References to erf 2090 and erf 2091 must be changed to 2190 and 2191 respectively throughout the case officer’s report.

Amend Annexure A
Add to A.1.1:
6 Rezoning of portions of Erf 1955 zoned Community Zoning 2: Regional (CO2) and Open Space Zoning 2: Public Open Space (OS2) respectively to General Business (GB6)
Adjust numbering accordingly.

Amend 4.12:
Social Housing Plan (number of units, size and unit types and proposed institutional mechanisms and funding) must be supported by a Feasibility Study and a Business Plan to be submitted to motivate the number of residential units proposed in each precinct, with the view to determine if the overall number of residential units can be increased to 80% of total floor area and the number of social housing can be increased from 20 to 30% floor area.

Note: In view of the fact that this is publicly owned land, this Tribunal is of the opinion that a higher percentage of affordable social housing should be considered for all the precincts

5.1.17 Proposed land use of the existing historic hospital building in the event of the hospital being de-commissioned. The proposed land uses shall be land uses such as retail, restaurants, hotel, art gallery, place of instruction and offices, which promote public accessibility as much as possible, to the satisfaction of the authorized official.

References to approval by ‘the Director: Development Management’ must be changed to ‘the authorized official’ throughout the report.
