UNANIMOUSLY RESOLVED that:
a. The application for Subdivision of Portion 19 of Vergenoegd Farm 653 into two (2) portions in accordance with Subdivision Plan No SUB01.C dated 24/10/2017, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as contained in Annexure A.

b. The application for Rezoning of the proposed Portion 1 from Agricultural Zone to Subdivisional Area consisting of Single Residential Zone 1, General Residential Subzone 1 (group housing units), General Residential Subzone 2 (flats), Community Zone 1 (pre- and primary school), Local Business Subzone 2 (place of assembly for clubhouse purposes including functions, resident’s bar and restaurant), General Business Subzone 1 (retail shop and offices), Open Space Zone 3 (private roads and open spaces), Transport Zone 2 and Utility Zone (on-site waste water treatment) in accordance with Subdivision Plan No SUB01.C dated 24/10/2017, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as contained in Annexure A.

c. The application for Approval of the Urban Design Framework dated August 2016 (Rev 2) and Master Landscape Plan No. 77141-LMP-001 dated 23/01/2016, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as contained in Annexure D.

d. The application for Subdivision & Phasing of the unregistered Portion 1 of portion 19 of Farm 653 into 9 subdivisions (‘superblocks’) in accordance with Subdivision Plan No SUB02.B dated 5/05/2018, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as contained in Annexure A.

e. The application for Subdivision of a portion of unregistered portions 1 to 4 into 217 General Residential Subzone 1 erven (Single Title), 8 General Residential Subzone 2 erven (flats), 1 Local Business Zone 2 erf (club house purposes), 1 Community Zone 1 erf (Place of Instruction), Open Space Zone 3 (private roads & private open space, gatehouse, refuse room & parking), Transport Zone 2 (Public Road) and Utility Zone (on-site waste water treatment plant) in accordance with Subdivision Plan No’s. SUB03.1D, SUB03.2B, SUB03.3C and SUB03.4B, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as contained in Annexure A.

f. The application for Permanent Departure to permit garages on the General Residential Subzone 1 erven 0m in lieu of 5m from the internal road kerb, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.

g. The application for Permanent Departure to permit a 1m street building line in lieu of 4.5m on all General Residential Subzone 2 erven, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.

h. The application for Consent Use for the proposed club house facility (place of assembly, restaurant, sale of alcoholic beverages) on proposed Portion 49 zoned Local Business Zone 2, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as contained in Annexure A.

i. The application for Consent Use to permit utility services in Open Space zone 3 zoned erven, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as contained in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:

The application is compliant with Section 99(ii) and Section 99(iii) of the Municipal Planning By-Law.

Amend last bullet:
Bulk municipal civil services, except sewerage services can be provided for the proposed development.

Amend Annexure A:
2.6 The approved architectural and design guidelines, included as part of the Vergenoegd Village Urban Design Framework, shall be managed and enforced by the Master Owners Association.

2.16.8 Construct the mini-bus taxi embayment on the downstream of the main access on both sides Kramat Road.

2.17 That once the Vergenoegd Village has reached 80% completion, no further rate clearance will be granted by the City of Cape Town, until the Developer/Owner has implemented the following:…
