RESOLVED UNANIMOUSLY

a. That the application for rezoning of Erf 18450, Durbanville from Single Residential Zone 1 to General Residential Zone 1in terms of Section 42(a) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-Law, 2015, in accordance with Plan No 17090-001 Rev C dated 2018-06-25 attached as Annexure C, and subject to the conditions contained in Annexure A.

b. That the application for subdivision of Erf 18450, Durbanville into 5 portions to accommodate a group housing development consisting of four (4) group housing units and a private road in terms of Section 42(d) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-Law, 2015, in accordance with Plan No 17090-001 Rev C dated 2018-06-25 attached as Annexure C, and subject to the conditions contained in Annexure A.

c. That the Regulation departure from the street building line (3.5m in lieu of 5m) at Erf 18450, Durbanville in terms of Section 42(b) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-Law, 2015, in accordance with Plan No 2018-005-01 Rev 04 dated July 2018 attached as Annexure D.

d. That the Regulation departure from the common (southern) building line (1m in lieu of 3m) at Erf 18450, Durbanville in terms of Section 42(b) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-Law, 2015, in accordance with Plan No 2018-005-01 Rev 04 dated July 2018 attached as Annexure D.




e. That the Regulation departure from the common (western) building line (2.83m in lieu of 3m) at Erf 18450, Durbanville in terms of Section 42(b) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-Law, 2015, in accordance with Plan No 2018-005-01 Rev 04 dated July 2018 attached as Annexure D.

f. That the application for approval of the Site Development Plan in respect of Erf 18450, Durbanville in terms of Section 42(i) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-Law, 2015, in accordance with Plan No 2018-005-01 Rev 04 dated July 2018 attached as Annexure D.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report and agreed to delete 7.1.8.
