RESOLVED UNANIMOUSLY
That an administrative penalty in the amount of R45 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of contravening rezoning conditions 3.1.4 and 3.1.5 relating to the maximum number of seats and maximum floor space permitted on Erf 594 Chapmans Peak.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report except reasons 6.3 and 6.5 which are amended as follows:
6.3. The gravity of the contravention is serious because of the impact of the parking overspill on a prominent corner.
6.5. The conduct of the owner is willful and cannot be condoned.
