RESOLVED UNANIMOUSLY

a. That the application for Consent in terms of Item 112(c) of the Development Management Scheme to permit a freestanding base telecommunication station on Remainder Erf 203 Schaap Kraal, Vlei Road in Philippi BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, subject to conditions in Annexure A and in accordance with the plan in Annexure C

b. That the application for a permanent departure to allow for a street building line of 5 m in lieu of 10 m from Vlei Road on Remainder Erf 203 BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, subject to conditions in Annexure A and in accordance with the plan in Annexure C.
Conditions 3.4, 3.6 and 3.7 are amended as follows:

3.4 The owner must ensure that regular measurements are taken to ensure that the base station and related infrastructure is in compliance with the ICNIRP public exposure guidelines. Such measurements are to be to the cost of the applicant and made available to the Director: City health.

3.6 That if owner decommissions the infrastructure, and where the site has been disturbed, shall rehabilitate the site to its original state or a state acceptable to the Director: Development Management

3.7 Director: Development Management will review the approval should future scientific evidence support a link between electromagnetic field radiation and health, which could result in the decommissioning of the station.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason 7.1.6:

7.1.6 The proposal is compliant with Section 99 of the Municipal Planning By-Law, 2015
