RESOLVED UNANIMOUSLY

That the application for departures, as set out in Annexure A, for Erf 55148 Cape Town at Claremont, BE APPROVED in terms of 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.


REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 7.1, 7.2, 7.10 which are amended and added an additional reason 7.12:

7.1. The proposal is compatible with the surrounding context.
7.2. The proposal is consistent with the character of the area and will not have a significant negative impact on the neighboring properties.
7.10. The proposal will not have a negative impact on any heritage in resources given the context of an approved building plan for the property.
7.11. The proposal is desirable and does not have a significant impact on existing rights, subject to implementation of the mitigation measures.
7.12 Given that there is an approved building plan the application as amended is considered to be desirable.
