RESOLVED UNANIMOUSLY
a. That the application for removal of restrictive title conditions D(i) 1 and 3 in Title Deed No T33689/2014, BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-Law, 2015.
b. That the application for rezoning in respect of Erf 10466, Bellville from Single Residential SR1 purposes to Local Business LB1 purposes BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-Law, 2015, in accordance with the Site Layout Plan attached as Annexure C and subject to the conditions contained in Annexure A.
c. The application for permanent departures in respect of Erf 10466, Bellville, to allow
- the relaxation of the common boundary building line from 3,0m to 1,5m and 2,0m,
- the relaxation of on-site parking provision from 6 bays to 5 bays,
- the increase in the permissible carriage way crossing width from 8,0m to 12,8m and
- the reversing of vehicles across the public footway
BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-Law, 2015, in accordance with the Site Layout Plan attached as Annexure C and subject to the conditions contained in Annexure A.
d. That the deviation from the Boston Policy Plan be noted.
Condition 2.4 is amended as follows:
2.4 That the owner/developer shall pay a development charge of R73 213.00 in accordance with the approved Development Charges Policy for Engineering Services for the City of Cape Town.
REASONS FOR DECISIONS:
The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that reads as follows:
7.1.8 In view of the site specific circumstances the deviation from the Boston Policy Plan is supported
