RESOLVED UNANIMOUSLY

a. That the application for removal of conditions C(6) and C(7) of title deed T24806/1993 relating to Erf 1776, Durbanville BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015.

b. That the application for deletion of the conditions removed per paragraph 8.1 above of the planning approval with regard to Erf 1776, Durbanville, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015.

c. That the application for rezoning of Erf 1776 from Single Residential 1 to General Residential: Subzone 2 to accommodate the extension of the retirement home on Erf 19437, Durbanville (Extension 2) BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with plan no 7600-005-100 to 104; revision 04, dated 20 July 2017 and 7600-005-303, revision 00, dated, 7 June 2017, subject to the conditions contained in Annexure A.

d. That the application for consolidation of Erven 1776 and 19437 (consolidated erf), Durbanville BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with plan no 7600-005-100 to 104; revision 04, dated 20 July 2017 and 7600-005-303, revision 00, dated, 7 June 2017, subject to the conditions contained in Annexure A.

e. That the application for regulation departure for the consolidated erf 19437 from the 4.5m street building line to 3,4m BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with plan no 7600-005-100 to 104; revision 04, dated 20 July 2017 and 7600-005-303, revision 00, dated, 7 June 2017,, subject to the conditions contained in Annexure A.

f. That the application for amendment of conditions of approval for the consolidated erf 19437 dated 5 December 2013 (refer Annexure H) BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 to address the following:
1.2 Number of units: 191
1.5 Coverage: 43%
1.6 Bulk: 0.97
1.7 Parking: Minimum of 177 bays (0.5 bays per bedroom)
2.3 That the proposed development shall be substantially in accordance with the SDP attached as Annexure D.
4. The development should be restricted to a retirement village consisting of 191 units with 314 beds, a frail care centre with 38 beds and associated facilities.
4.2 On-site parking shall be provided at the following minimum rates:
Frail Care Centre – 0.5 bays per bedroom
Retirement Home – 0.5 bays per bedroom

Conditions 2.3, 29 and 2.13.1 are amended as follows:

2.3 That the use of the consolidated property be limited to a retirement home consisting of 191 residential units (with 314 beds) and a 38 bed-frail care facility.

2.9. The approved landscaping plan shall be implemented by and at the cost of the owner/developer within 3 months of practical completion of building work or a longer period as approved by the Director: Development Management. Implementation shall be to the satisfaction of the Director Development Management (or his/her delegate), i.e. in consultation with the Regional Manager: Environmental Management and Recreation & Parks.

2.13.1.The revised development charges to the amount of R1 088 232.37 (VAT inclusive) as reflected on the Development Charges Calculator dated 9 November 2017, be paid by the developer towards the provision of bulk municipal civil services in accordance with the relevant legislation and as determined by Council’s Policy.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
