Resolution details

RESOLVED

a. That the application for the removal of restrictive title deed conditions [clause B.(a)] to permit the construction of a free standing cellular communication base station on the property, BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions in attached Annexure A.

b. That the application for Consent Use in respect of Erf 627, Goodwood to permit the installation of a free standing cellular communication mast base station BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law, 2015, in accordance with the site plan, attached as Annexure C (Plan No N00459 dated 08-07-2016),

c. That the application for the deletion of conditions of an existing approval which read similar to the abovementioned restrictive conditions BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions in attached Annexure A.

REASONS FOR DECISION:

The MPT approved all the reasons in the planner’s report relating to the removal of the restrictive Title Deed Conditions and deletion of conditions of an existing approval, the reasons for refusal of Recommendation 8.2 is as follows:

1. Visually intrusive in regard to neighbours in Borghorst Street.
2. Sufficient attentions have not been given to alternative locations in that area.
3. Embedded in residential precinct.
4. The basic proposal is not fully compliant with the spirit and intent of the Cell Mast Policy.
