RESOLVED UNANIMOUSLY
a. The application for the rezoning of Erf 20659, Goodwood, Leonsdale, from Single Residential 1 (SR1) to Community Zone 1 (CO1) BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law (2015) (MPBL) to permit the existing church as a primary use right, subject to conditions attached as Annexure A.
b. That the application for a consent use to permit a freestanding base telecommunication station on Erf 20659, Goodwood, Leonsdale, BE REFUSED in terms of section 98(c) of the Municipal Planning By-Law, 2015.
c. That the application for the permanent departures to relax the 5m common boundary building lines to 1,8m, 4,7m and 4,675m respectively BE REFUSED in terms of section 98(c) of the Municipal Planning By-Law, 2015.
d. That the application for the removal of Title Deed Condition B.(i)(a) of Title Deed T27165/76 to permit the use on the property for a church on Erf 20659, Goodwood, Leonsdale, BE APPROVED in terms of section 98(b)(i) of the Municipal Planning By-Law, 2015.
APPLICATIONS REFUSED IN TERMS OF SECTION 98 (b) OF THE BYLAW
Applications in the planner’s report numbered 1.2, 1.3, are Refused.
That all conditions be deleted.
REASONS FOR DECISION:
The MPT approved all the reasons in the planner’s report relating to the rezoning and the removal of the Title Deed Condition, the reasons for refusal of Recommendation 8.2 and 8.3 is as follows:
1. The cell mast will be embedded in a residential area.
2. Sufficient attention has not been given to alternative sites in that area.
3. Visual intrusion as well as impact on amenity would be prevalent.
