Resolution details

UNANIMOUSLY RESOLVED that:

a. The application for relaxation of restrictive title deed conditions for Erf 4985 Constantia, as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The application for consent in terms of Item 21(c) of the Development Management Scheme to permit Erf 4985 Constantia to be used as a place of instruction BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to conditions contained in Annexure A.

c. The application for departures for Erf 4985 Constantia, as contained in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.


REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 7 as follows:

The setback departures relating to the buildings are technical in nature and relates to the existing buildings.

Amend conditions as follows:

1.3.2 Item 47(e): To permit the place of instruction (ECD Centre) to be setback 3.5m and 1.5m respectively in lieu of 5m from the western common boundary.
