Resolution details

UNANIMOUSLY RESOLVED that:

a. The application for deletion restrictive title deed conditions, as contained in Annexure A in respect of Erf 174179, 37 William Street, Observatory BE APPROVED in in terms of Section 98(b) of the Cape Town Municipal Planning By-Law, 2015 subject to conditions contained in Annexure A attached.

b. The application for the departures as contained in Annexure A attached in respect of Erf 174179, 37 William Street, Observatory BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law subject to conditions contained in Annexure A attached.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reasons as follows:

1. The proposal complies with the Integrated Development Plan, Cape Town Spatial Development Framework, Table Bay District Plan as well as Council’s Densification policy
7. The height of the building does not inherently render it out of place within this context.

Delete reason 3


Add new reasons:
- The site is not in a Heritage Protection Overlay Zone and Heritage Western Cape does not require a Heritage Impact Assessment.

- Mitigating conditions will be imposed.

Amend conditions:
4.2 An amended SDP shall be submitted and shall ensure the refined aesthetic/architectural designs of the facades of the building and activation of street edges to align with the Urban Design Policy, in particular along William and Liskeard Streets, where feasible and practical, and shall be to the approval of the Director: Development Management, in consultation with the Director: Urban Integration (Urban Design).

4.5 Proof of cession of Liskeard Roads North and west ceded to the City shall be presented prior to final building plans unless determined otherwise by the Director: Development Management as illustrated on site plan in Annexure I.
