UNANIMOUSLY RESOLVED that:
a. The application in terms of Section 42(a) of the By-Law, for Rezoning from General Residential GR5 to General Business GB4 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 and as referred to in Annexure A.
b. The application in terms of Section 42(b) of the By-Law for departures BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 and as referred to in Annexure A.
c. The application for Consent for underground rights in terms of Section 42(i) of the By-Law to permit a basement on property zoned TR2 (Transport Zone) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 and as referred to in Annexure A.
d. The application for Council’s Approval in terms of Section 42(i) of the By-Law to permit a new building in a Heritage Protection Overlay Zone BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 and as referred to in Annexure A.
e. The application for Council’s approval in terms of Section 42(i) of the By-Law to permit a building within 5m of a designated metropolitan road BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 and as referred to in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend conditions as follows:
2.2 Notwithstanding the provisions of Item 60 of the DMS, the maximum permissible development envelope (height, coverage and building lines) shall be substantially in accordance with the Site Development Plans attached as Annexure C to the satisfaction of the Director: Development Management.
2.3 The encroachment of the basements onto the TR2 zone along St Georges Road shall require a right of way servitude as well as servitude in respect of the underground rights to be registered over this TR2 zoned portion at street level to the satisfaction of the Director: Development Management [in consultation with TDA: Integrated Transport Planning Department (Transport Impact Assessment and Development Control)].
