RESOLVED UNANIMOUSLY
That an administrative penalty to the amount of R49 500.00 (15%) BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law; 2015 in respect of Erf 393, Matroosfontein in accordance with the Site Plan attached as Annexure B.
REASONS FOR DECISION:
1 The property owner was willing at all times to assist in the process.
2 The unlawful activity has been in operation for more than 30 years; however the property owner has only indicated that he is operating for more than 12 months.
3 Numerous complaints have been received from surrounding neighbors, the city’s Liquor Unit as well as Sub Council.
4 The applicant submitted incorrect information to Council about the true, full extent of the operation.
