UNANIMOUSLY RESOLVED:
That an administrative penalty in the amount of R5 817.00 BE APPROVED for the unauthorised building, in terms of section 98 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 6506, 4 Livingstone Street, Strand.
REASONS FOR DECISION:
1. The owner is responsible for the unlawful building work.
2. The owner willfully contravened the law while he knew the consequences of the unlawful building work.
3. The duration of the transgression is quite short, the unlawful garage only appears on 2017 satellite imagery.
