RESOLVED UNANIMOUSLY
a. That the application for departure in terms of Section 126(a) of the Municipal Planning By-Law to allow for the ground floor of a building to be raised more than 1,5m from existing ground level on Erf 4232, Gordon’s Bay, BE APPROVED in terms of Section 98 (b)(i) of the Cape Town Municipal Planning By-Law, 2015, subject to conditions as contained in annexure A, in accordance with the plan in Annexure C.
b. That the application for departure for relaxation of the 3m common building line (Adj to Erf 4231) to 0m for the purpose of erecting a raised deck and staircase in respect of Erf 4232, Gordon’s Bay, BE APPROVED in terms of Section 98 (b)(i) of the Cape Town Municipal Planning By-Law, 2015, subject to conditions as contained in annexure A, in accordance with the plan in Annexure C.
c. That the application for departure for relaxation of the 3m common building line (Adj to Erf 4231) to 2,08m for the purpose of erecting a pool house in respect of Erf 4232, Gordon’s Bay, BE APPROVED in terms of Section 98 (b)(i) of the Cape Town Municipal Planning By-Law, 2015, subject to conditions as contained in annexure A, in accordance with the plan in Annexure C.
d. That the application for departure for relaxation of the 3m common building line (Adj to Erf 4240) to 1,92m and 2,8m for the purpose of erecting a raised deck in respect of Erf 4232, Gordon’s Bay, BE APPROVED in terms of Section 98 (b)(i) of the Cape Town Municipal Planning By-Law, 2015, subject to conditions as contained in annexure A, in accordance with the plan in Annexure C.
APPLICATIONS GRANTED IN TERMS OF SECTION 98 (b) OF THE BYLAW (ANNEXURE A)
Application 1.2 is amended as follows:
1.2 Departure for relaxation of the 3m common building line (Adjacent to Erf 4240) to 2, 8m and 1,92m for the erection of a raised deck.
REASONS FOR DECISION:
The MPT approved the reasons as set out in the planner’s report, except 7.1.1 which is amended as follows:
7.1.1. The proposed encroachment for a pool house is limited in extent (0,92m) and is only for a small corner portion of the structure. There will therefore be no notable impact on existing rights of the adjoining property.
