RESOLVED UNANIMOUSLY

That an administrative penalty for the unauthorised land use (liquor shop) in the amount of R7600 in terms of Section 129 and 42(q) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 8734 located at 14 Kanferboom Street, Lentegeur, Mitchells Plain, BE APPROVED, in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law 2015.

REASONS FOR DECISION:

1. The duration of the unauthorized use has been fairly long (at least 3 years).
2. The applicant has not stopped the illegal activity since becoming aware of its unauthorised nature, neither did he apply for the administrative penalty.
3. The operators have previously contravened the By-Law and continued to operate despite the previous refusal.
