UNANIMOUSLY RESOLVED that:
a. The application for the subdivision of Remainder Erf 82363 Cape Town into 5 portions, as per the plan of subdivision LUM/00/82363, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
b. The application for the rezoning of portions of Remainder Erf 82363 Cape Town, from Transport Zone 1 to Local Business Zone 2, General Residential Subzone GR2, and General Industrial Subzone GI1, as shown on the plan of subdivision LUM/00/82363, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
c. The departures, as contained in Annexure A for Remainder Erf 82363 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
AMEND CONDITIONS:
Rephrase paragraph 3.2.1 as follows:
The Department shall reconsider the development charge applicable which shall be calculated in accordance with the Development Charges Policy.
Rephrase 2.1.1 as follows:
Building plans for the property shall be to the satisfaction of Council’s Urban Integration Branch to ensure consistency with Council’s Urban Design Policy.
