RESOLVED
That the application for temporary land use departure in respect of 18030, Kuilsriver in order to permit a business (trade with used building materials) on the premises BE APPROVED in terms of 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.
CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BYLAW
1. That the development and use of the property shall be in general accordance with the Site Development Plan attached to the report.
2. That the approval granted for the temporary departure shall be valid for a period of five years.
3. That the property shall only have a left in and left out for vehicles entering and leaving the property. The aforesaid shall be to the standards and requirements of the City’s TCT: Asset and Maintenance and TCT: Integrated Transport Planning Departments.
4. That the Site Development Plan and upgrades on the property required to implement the SDP be done within 3 months of the final notification of the decision of this application.
5. That the Standard provision with respect to health requirements be adhered to, to the satisfaction of such Department.
REASONS FOR DECISION:
1. The proposals support the Economic Development Strategy of the City as it will create job opportunities.
2. The low intensity of the business will generate minimal trips from and to the site.
3. The temporary departure approval will not undermine the principles of the Spatial Development Plan, due to its temporary nature.
4. No permanent structures are proposed that will affect the future potential or use of the property.
5. It is located on Van Riebeeck Road, which is a road of economic activity as well as a transport route.
6. Vehicles will be able to safely enter and exit as there is sufficient width and turning space on the site to do so.
