RESOLVED UNANIMOUSLY
a. That the application for temporary land use departure in order to operate a backpacker’s lodge from Erf 4896, Strand, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.
b. That the application for approval of the Site Development Plan No’s. SK001 Rev C dated 16/11/2016, SK002 Rev C dated 16/11/2016, SK003 dated 11/04/2016, SK003 Rev E dated 21/11/2016, SK007 Rev C dated 11/11/2016, SK008 dated 11/11/2016 & SK009 Rev C dated 11/11/2016, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.
REASONS FOR DECISION:
1. The application does not comply with Section 45 (1) (c) and 99 (1) (a) of the Municipal Planning Bylaw.
2. The proposal does not comply with the City’s Guest Accommodation Policy.
3. The proposed structures will have a definite negative impact on the streetscape.
4. The scale and nature of the proposed structures is inappropriate and not compatible with the current residential context.
5. The subject property will not retain an overtly residential appearance.
6. The proposed multi storey structure will negatively impact on the privacy of the adjacent properties once developed.
7. Until the contrary is proven, the proposed structures are not considered suitable for human habitation.
8. The proposed use will impact negatively on the health, safety and wellbeing of the surrounding community.
9. The proposed use for temporary land use departure is considered an attempt to circumvent the intention of the zoning scheme.
10. The applicant has not satisfactory motivated his intent to operate from the premises on a temporary basis and relocate thereafter.
11. The conduct of the applicant/owner to erect the structures and boundary fence without the necessary approved buildings plans cannot be condoned.
