RESOLVED UNANIMOUSLY:
That the application for a consent use in terms of Section 42(i) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit the operation of a house shop (takeaway) from a portion of erf 3453, Mandalay, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as set out in the attached Annexure A.
2. CONDITIONS IMPOSED IN TERMS OF SECTION 100 OF THE CAPE TOWN MUNICIPAL PLANNING BYLAW, 2015
TRANSPORT AND URBAN DEVELOPMENT AUTHORITY
Condition 2.1 and 2.2 is amended to reads as follows:
2.1 That a revised site plan, indicating the accommodation of the take away in a formal structure which is not more than 20m² in extent, is considered ancillary to the dwelling, is architecturally similar to the dwelling and also in a position adjacent the main dwelling setback from Stinkwood Road, shall be submitted to the Director: Development Management for approval prior to building plan approval or commencement of the activity.
2.2 That the extent of the activity shall be limited to the portion of not more than 20m² in extent as indicated on the revised site plan and building plans be submitted in accordance therewith.
New condition 2.10 to be added:
2.10 The container shall not be used for the purposes of a house shop.
Note: That the conditions under, FIRE AND RESCUE SERVICES be renumbered as 2.11 and 2.12
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report.
