RESOLVED UNANIMOUSLY:
That the application for the subdivision of Portion 198 of the Farm Firland, No 959, Stellenbosch into three (3) portions namely portion B (approximately 1.4640ha in extent) zoned Rural, portion C (approximately 1093 m² in extent) deemed to be zoned Transport Zone 2, and Remainder (approximately 3.6588ha in extent), having a split zoning of Rural, General Business Zone 1and Agriculture, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A hereto.
CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BYLAW
New condition to reads as follows:
2.2.2 That a temporary servitude right of way as to be determined by the Commissioner: TDA, be registered over the newly created portion B, generally in accordance with the Plan of subdivision, Annexure C.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report.
