UNANIMOUSLY RESOLVED that:
a. The application for deletion of restrictive conditions, as set out in Annexure A, for Erven 96503 & 96505 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of consolidation LUM/00/96501A.
b. The application for consolidation of Erf 96501, Remainder Erf 96502, Erf 96503, Remainder Erf 96504, Erf 96505, Erf 96529 & Erf 97783 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for the subdivision of the consolidated Erf 96501, Remainder Erf 96502, Erf 96503, Remainder Erf 96504, Erf 96505, Erf 96529 & Erf 97783 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/00/96501B, subject to the conditions contained in Annexure A.
d. The application for departures, as set out in Annexure A, for the consolidated Erf 96501, Remainder Erf 96502, Erf 96503, Remainder Erf 96504, Erf 96505, Erf 96529 & Erf 97783 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s
Report
AMENDMENTS TO CONDITIONS:
Replace condition 2.3.1:
‘A separate service connection cable, rated to supply the authorized capacity of the erf, must be installed to the point supply on the boundary of each erf of the subdivision. The cable shall be routed clear of all other private property, typically within the public road reserve.’
With:
‘A point of supply to serve all portions shall be provided on the boundary of Portion 13, along Glenhof Road. A single bulk supply may be provided to the development only if it is impracticable to provide individual metering at a central metering location. The metering location shall be positioned in such a way that unrestricted, 24-hour vehicular access from a public road is maintained.’
Replace condition 2.4.1:
‘A sewer connection shall be provided to each portion to the satisfaction of the Director Sanitation.’
With:
‘A sewer connection shall be provided to the boundary of Portion 13 along Glenhof Road to the satisfaction of the Director Sanitation.’
