Resolution details

UNANIMOUSLY RESOLVED that:

a) The application for the approval of Council as contained in Annexure A attached in respect of Erf 95635, 15 Wandel Street Cape Town BE APPROVED in terms of Section 98 of the Municipal Planning By-Law subject to conditions contained in Annexure A attached.

b) The application for the rezoning of the property from a General Residential Use Zone, Sub-zone GR4 to a General Business Use Zone, Sub-zone GB1 as contained in Annexure A attached in respect of Erf 95635, 15 Wandel Street Cape Town BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law subject to conditions contained in Annexure A attached.

c) The application for a departure as contained in Annexure A attached in respect of Erf 95635, 15 Wandel Street Cape Town BE APPROVED in terms of Section 98 of the Municipal Planning By-Law subject to conditions contained in Annexure A attached.

REASONS FOR DECISION:

1. The proposal complies with the CTSDF, Table Bay District Plan, Urban Design Policy and Parking Policy.
2. The proposal will not negatively affect the character of the area or impact negatively on the neighbouring properties.
3. Conditions will ensure that the impact of the proposal is limited and that the other uses permitted in terms of the General Business Zone are precluded.
4. The proposal will have no negative heritage impact.
5. The proposal complies with the criteria set out in Section 99 of the Municipal Planning By-Law, 2015.

Delete note folio 1182: ‘I am satisfied that the decision making criteria in
Section 39(5) of the LUPA and Section 47 of SPLUMA have been complied
with’.
Delete Annexure A on folio 1191 of the Agenda.
