UNANIMOUSLY RESOLVED that:
a. The application for the rezoning of a portion of Remainder Erf 65238 Cape Town from Community Zone 1 to Mixed Use Subzone MU1, Mixed Use Subzone MU2 and Mixed Use Subzone MU3, as indicated on the plan of subdivision LUM/00/65238, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
b. The application for the subdivision of Remainder Erf 65238 Cape Town into 11 portions as indicated on the plan of subdivision LUM/00/65238, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
c. The application for Council’s approval in terms of Item 64(e)(ii) of the Cape Town Development Management Scheme to permit parking bays at ground floor level located closer than 10m from Rosmead Avenue, on Remainder Erf 65238 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law.
d. The application for departures, as set out in Annexure A, for Remainder Erf 65238 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
e. The application for a departure to allow for buildings to be erected at 0m from the street building line, as set out in Annexure A, for Remainder Erf 65238 Cape Town, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
f. The application for street naming in terms of Section 136 of the Municipal Planning By-Law, as indicted on the plan of subdivision LUM/00/65238, for Remainder Erf 65238 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for rezoning, subdivision, departures,
street naming and approval for parking bays, for the reasons set out in the
Planner’s Report
The MPT REFUSED the application for departure, for the reasons set out in the planner’s Report.
Correction to condition:
3.4.8 ‘The developer shall enter into a contract with the ESO detailing the minimum hours per week the ESO must be on site and conferring the power on the ESO to halt any development that is inconsistent with the EMP’.
