UNANIMOUSLY RESOLVED
That the application for an amendment of the approved Site Development Plan for Erf 10344, Durbanville to develop a place of instruction (day-care facility) BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with Plan Number 1007_berg_mun07_01/09, printed 10 March 2017, attached as Annexure C, subject to the conditions contained in Annexure A.
CONDITIONS OF APPROVAL IN TERMS OF SECTION 98(B) OF THE BY-LAW
Condition 2.4.6 is amended as follows:
2.4.6 161 paved /surfaced parking bays and circulation routes generally in accordance with the Site Development Plan (Attached as Annexure C)
Conditions 2.4.8, 2.4.9 and 2.4.10 are added to read as follows:
2.4.8 Where feasible as many of the existing trees be retained
2.4.9 That the Boland Way and the Protea Way edges are to be landscaped with trees.
2.4.10 That any new boundary fences on the site needs to be visually permeable.
Conditions 2.5 to 2.12.3.1.3 under TCT Roads & Stormwater are deleted.
DEVELOPMENT CHARGES
That a note be inserted under the heading, Development Charges that reads:
“That these conditions will remain if it is consistent with Council’s own DC Policy”
REASONS FOR DECISION:
1. The proposal complies with the Northern District Plan and the City`s Early Childhood Development Land-Use Policy as well as the City wide Social Development Strategy.
2. The proposal complies with the provisions of the Development Management Scheme, is considered compatible with surrounding development and will not have any negative impacts on the surrounding community.
3. The traffic impact of the development is considered acceptable and adequate on-site parking will be provided.
4. Approval of the application will have a positive socio-economic impact.
5. The use and scale of the proposal as set out in the SDP is appropriate for the zoning.
