Resolution details

UNANIMOUSLY RESOLVED that:

a. The application for consent in terms of Item 112(c) of the Development Management Scheme for a freestanding base telecommunication station on Portion 27 of Cape Farm de Goede Hoop Number 930, Noordhoek, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. The application for departure 2.3, as set out in Annexure A, for Portion 27 of Cape Farm de Goede Hoop 930, Noordhoek, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015, and the application for departure 2.1, as set out in Annexure A, for Portion 27 of Cape Farm de Goede Hoop 930, Noordhoek, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 as follows: “Item 113(c)(i): To permit the freestanding base telecommunication station to be setback 5m in lieu of 10m from Dunedin Road.


REASONS FOR DECISION

1. The proposed freestanding base telecommunication station will not pose significant negative impact on the surrounding population and environment.
2. The visual impact of the mast will be acceptable given its 15m height and being camouflaged as a tree, located in an area in which trees are common. A landscaping plan to be submitted to the satisfaction of the Director: Development Management, and the engagement around more acceptable visual impact for the cell mast, resulting in an acceptable outcome
3. The approval of this application does not impact on any existing rights and does not lack desirability.
4. The freestanding base telecommunication station will allow for co-location.
5. The application complies with requirements of the City’s Telecommunication Mast Infrastructure Policy and is consistent with the Southern District Plan and the Municipal Spatial Development Framework.

AMEND CONDITIONS:
Insert 3.2.3 A landscaping plan must be submitted by the applicant which addresses additional tree planting as well as better treatment of base structures – for the approval of the Director: Development Management

The height should be fixed to 15m and the location of the mast shall be as far south as possible, remaining compliant with a 5m building line

REASON FOR REFUSAL AND AMENDMENT of departures:
Adherence to building lines of 5m will be in compliance with stated risk industry standards (also depicted on the drawing provided by the applicant) for distances from the property boundaries and which will also allow space for additional landscaping
