RESOLVED that:

The application for subdivision of the Remainder Erf 10 Chapman’s Peak, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/75/10, subject to conditions contained in Annexure A.

REASONS FOR DECISION:

1. The proposed erf sizes are significantly above the minimum of a 1000m² for the area.
2. The proposal will not adversely impact on the infrastructure in the area.
3. The proposal is consistent with the character of the area and will not have a significant negative impact on neighbouring properties.
4. The proposal will not have adverse negative traffic implications.
5. The proposal is consistent with the Cape Town Spatial Development Framework and complies with the Southern District Plan and the Cape Town Densification Policy.
6. The proposal will not have a negative impact on the streetscape.
7. The biophysical impact will be limited as development will be restricted to the area below the 33m contour.
