RESOLVED that:
a. The application for the subdivision of Erf 81375 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/00/81375, subject to conditions contained in Annexure A.
b. The application for departures for Erf 81375 Cape Town, as contained in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
1. The proposal will not significantly change with the character of the wider area and will not have a significant negative impact on neighbouring properties.
2. The level of densification proposed is contextually appropriate.
3. The proposal complies with the Southern District Plan and the Cape Town Densification Policy and is consistent with the Cape Town Spatial Development Framework.
4. There is adequate infrastructural capacity for the proposal.
5. Adequate and safe off-street parking will be provided
6. The proposal will have a positive socio-economic impact.
7. The proposal will not have a significant negative impact on the streetscape and surrounding neighbours.
8. The proposal is desirable and does not impact on existing rights.
9. Prior to subdivision, the maximum floor area permitted is 1500m². However the subdivision will result in a substantial reduction (due to the floor factor of 1 for erven less than 650m²) to a maximum floor space for all 3 erven combined of 662m².
10. The subdivision will also result in a reduction of the permitted height from 11m before subdivision to 10m after subdivision.
