UNANIMOUSLY RESOLVED:
a. That the application for consent in terms of a restrictive title deed condition (condition B(a)of T11379/1979) in terms of Section 42(h) of the City of Cape Town Municipal Planning By-Law in order to allow for the subdivision of Erf 4001, Kraaifontein, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law.
b. That the application for consolidation of Portion A of split Remainder of Portion 2 of Stellenbosch Farm 20 (3.67ha in extent) with Erf 4001, Kraaifontein (0.77ha in extent), to form an unregistered erf (4.44ha in extent), in terms of Section 42 (f) of the Municipal Planning By-Law, as per the consolidation plan, Plan No LP-5658-06 dated 22/02/2017 attached as Annexure C, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.
c. That the application for rezoning of the abovementioned consolidated erf (as per plan LP-5658-06 attached as Annexure C) to Subdivisional Area overlay zone, in terms of Section 42 (a) of the Municipal Planning By-Law, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.
d. That the application for subdivision of the abovementioned consolidated erf into 261 portions (86 Single Residential Zone 1 erven, 168 Single Residential Zone 2 erven, 1 Utility Zone erf to accommodate a stormwater management facility, 1 Open Space Zone 2 erf, and 5 Transport Zone 2 erven) in terms of Section 42 (d) of the Municipal Planning By-Law, as per the subdivision plan, LP-5658-02 Rev C dated 22 February 2017 attached as Annexure E, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.
e. That the application for consolidation of Portion B of split Remainder of Portion 2 of Stellenbosch Farm 20 (2.18 in extent) with Remainder Portion 38 of Stellenbosch Farm 20 (3.37ha in extent), to form an unregistered erf (5.55ha in extent), in terms of Section 42 (f) of the Municipal Planning By-Law, as per the consolidation plan, Plan No LP-5658-07 dated 22/02/2017 attached as Annexure D, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.
f. That the application for rezoning of the abovementioned consolidated erf (as per Plan LP-5658-07 attached as Annexure D) to Subdivisional Area overlay zone, in terms of Section 42 (a) of the Municipal Planning By-Law, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.
g. That the application for subdivision of the abovementioned consolidated erf into 323 portions (89 Single Residential Zone 1 erven, 227 Single Residential Zone 2 erven, 1 Community Zone 1 erf, 2 Open Space Zone 2 erven, and 4 Transport Zone 2 erven) in terms of Section 42 (d) of the Municipal Planning By-Law, as per the Subdivision Plan, LP-5658-02 Rev C dated 22 February 2017 attached as Annexure E, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.
h. That the application for rezoning of Erf 29366, Kraaifontein to Subdivisional Area overlay zone, in terms of Section 42 (a) of the Municipal Planning By-Law, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.
i. That the application for subdivision of Erf 29366, Kraaifontein into 152 portions (149 Single Residential Zone 2 erven, 1 Utility Zone erf to accommodate an electrical substation, 1 Open Space Zone 2 erf, and 1 Transport Zone 2 erf) in terms of Section 42 (d) of the Municipal Planning By-Law, as per the subdivision plan, LP-5658-02 Rev C dated 22 February 2017 attached as Annexure E, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.
j. That the application for approval of a phasing plan to allow for the development in 6 phases in terms of Section 42(e) of the Municipal Planning By-Law, as per the phasing plan, LP-5658-02 Rev C dated 22 February 2017 attached as Annexure E, BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-Law, subject to the conditions stipulated in Annexure A.
