UNANIMOUSLY RESOLVED that:
An administrative penalty of R 29 400.00 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 58753 Cape Town at Lansdowne.
REASONS FOR DECISION:
1. The applicant was fully aware of the need to comply with conditions of approval but intentionally deviated from the provisions of the approved Site Development Plan and only thereafter submitted the application for the amendment of the relevant conditions.
2. The applicant has not adequately explained how it came to be that the owner disregarded the planning processes and conditions of approval.
3. The contravention has been in existence for at least six months.
