RESOLVED:
That the application for Consent Use in respect of Erf 47, Klipheuwel, to permit the proposed Tourist Facility, i.e. mainly a restaurant, as depicted on Site Layout Plan No 47/16 (see Annexure C), BE REFUSED in terms of Section 98 (b) of the Municipal Planning Bylaw,
REASONS FOR DECISION:
1. The proposal is regarded as a fully-fledged business/restaurant within a pure ‘rural’ area, which does not compliment the surrounds;
2. The proposal is not considered to be compatible with the Northern District Plan, which states that smallholding areas should be retained for ‘rural living’;
3. The proposal is located in an area with infrastructural constraints (no sewerage connection, unpaved roads, flood-line areas etc.);
4. The proposal is not easily accessible from the surrounding road network;
5. The proposal being located in a cul-de-sac is considered to create congestion along the abutting road.
6. The proposal is considered to impact negatively on neighbours in terms of dust pollution, additional traffic and related noise;
7. The road network is not designed to accommodate the excess traffic, creating maintenance concerns;
8. The proposal is not supported by Council’s Transport for Cape Town Department, based on the above traffic related concerns.
