UNANIMOUSLY RESOLVED:

a) That the application for Consent to operate a guest house on Erf 2947, Durbanville BE APPROVED in terms of Section 98 (i) of the City of Cape Town Municipal Planning By-Law, 2015, in accordance with the Site Plan attached as Annexure C, subject to the conditions contained in Annexure A.

b) That the application for the Removal of Restrictive Title Condition B.6 of Title Deed T68812/08 relating to Erf 2947, Durbanville BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.


REASONS FOR DECISION:

1. The proposal entails 4 guest rooms which is one guest room less than per the temporary departure approval. No complaints, issues or negative impacts have been raised during the operation of the existing guest house as a temporary land use departure. It is therefore not considered to have a detrimental impact on the health, safety or welfare of the surrounding community.
2. The proposal conforms to the guest accommodation policy and is deemed compatible with the existing character of the area.
3. The provision of tourist accommodation supports job creation and contributes to the economy of the City of Cape Town.
4. The proposal would not have a negative impact on the existing services network of the surrounding area as confirmed by the relevant services departments.
5. Adequate on-site parking and sufficient infrastructure exists to support the development proposal. This is confirmed by the departmental comments per Annexure E to this report.
6. The owner/manager resides on the property and therefore ensures a permanent resident on-site. This will mitigate any possible impacts.
7. The removal of the Restriction Title Deed is not deemed to be a threat to the existing rights or well-being of the community.
