RESOLVED

That the application for a consent use in order to permit the operation of a house shop from the portion of the property on Erf 1910, Weltevreden Valley, BE REFUSED in terms of Section 98(c)(iii) of the City of Cape Town Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

1. The locational logic of the site so close to a shopping center.
2. Circumstances for accommodating the operator are not contained in the application and the situation does not comply with policy.
3. Locality of the house shop in a cul-de-sac will impact negatively on neighbouring properties.
4. Strong community objections in the form of the local Residents Association ward councilor, as well as immediate neighbours. The objections relating mainly to the conduct of the owner and their patrons.
