RESOLVED UNANIMOUSLY

That a 0% administrative penalty be imposed in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 11083, Gordons Bay in accordance with plan no 2016-17.

REASONS FOR DECISION:

1. Although the unauthorized building work does contravene the Development Management Scheme, its impact is minimal and its nature is such that it provides a social benefit.
2. An attempt has been made to regularize the unauthorized building work, by the owner immediately submitting the application for an administrative penalty, voluntarily.
3. The nature of the contravention is low key with no notable impact on existing rights.
