UNANIMOUSLY RESOLVED that:
b. An administrative penalty in the amount of R 14 766.00 IS APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 9051, Gugulethu, in accordance with Plan no.: SOC2 dated 7 July 2015.
REASONS FOR DECISION:
1. The nature, gravity and extent of the carport contravention is considered as minor.
2. Although a land use application has been submitted to rectify the unlawful use, the owner has not stopped the unauthorised use of the liquor shop which has been operating for 14 months.
