UNANIMOUSLY RESOLVED that:
a. An administrative penalty in the amount of R 1 474.00 IS APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 60765 Cape Town at Lansdowne.
REASONS FOR DECISION:
1. Only portions of the roof have been built in contravention of the Municipal Planning By-Law, 2015.
2. The contravention can be considered to be extremely minor in extent as both height contraventions only amount ±550mm. The actual height contravention is only of 0,39m and 0,15m, respectively.
3. The gravity can be considered to be low.
4. The owner has shown good faith in the administrative penalty process.
5. The owner has not previously contravened the By-Law or any other planning law.
